Terms and conditions

These terms govern use of Yupzap, operated by Merdot Private Limited. Read them with the Privacy policy, Community guidelines, Copyright policy and Child safety standards. Feature availability can depend on your app version, device and location.

Nothing in these terms removes a duty of Yupzap, creates immunity for unlawful conduct, or excludes a right or remedy that applicable law does not allow to be excluded.

Eligibility and your account

You must be at least 13 and meet any higher minimum age that applies where you use the service. If you cannot validly agree to these terms yourself, a parent or legal guardian must authorise use where the law permits it. Any legally required parental consent and child-protection safeguards still apply. Do not misstate your age to bypass them.

Provide accurate information, use identifiers you are entitled to use and keep account access secure. Do not impersonate another person, misrepresent a business or professional qualification, share sign-in codes or create accounts to evade a restriction. Tell support if you suspect unauthorised access. You are not automatically responsible for activity merely because an account was compromised; responsibility depends on the facts and applicable law.

    Your content remains yours

    You retain the rights you own in content you submit. You must have the permissions needed for the material and people represented in it, including applicable copyright, privacy and publicity rights. A public copy, a credit line or the same material appearing in another post does not establish permission.

    You grant Merdot Private Limited a non-exclusive, royalty-free permission to host, store, reproduce, transmit, technically format and display your content only as needed to operate the Yupzap features you choose, deliver it to the audience you select, maintain security and comply with law. Technical formatting includes compression, thumbnails and format conversion needed for delivery. Providers may exercise these permissions only on our behalf for those purposes.

    This permission does not transfer ownership, authorise unrelated advertising use of your identity or content, or grant a general right to sell your content or train unrelated AI models on it. A separate use requiring permission needs a separate agreement or other valid legal basis.

    The permission ends when the content is deleted from the service, except to the extent needed for a lawful preservation duty, a limited backup lifecycle or an existing sharing feature you authorised while content was available. It does not remove rights other users independently hold or recall copies they lawfully saved. These exceptions are not an unlimited commercial licence.

      Use the service lawfully and respectfully

      Follow the Community guidelines. Do not use Yupzap for exploitation, threats, fraud, unlawful discrimination, non-consensual intimate imagery, copyright infringement or other illegal conduct. These rules cover content you create, upload, reshare, quote, send or link to and apply to synthetic media as well as recordings.

      Do not scrape or harvest personal information, enumerate users, send unsolicited bulk messages, circumvent access controls or rate limits, distribute malicious code, interfere with the service or automate abusive activity. Ordinary use of sharing features for individual public links is permitted. These restrictions do not prevent activity protected by nonwaivable law.

      Do not misleadingly present realistic manipulated media as an authentic record of a person or event. Use clear contextual labels where required and do not remove provenance or safety labels to deceive others. Creative or satirical intent does not excuse exploitation, threats or infringement.

        Subscriptions, billing and cancellation

        A paid plan is offered only through an actual purchase flow. Review the features, price, taxes, billing interval, renewal terms and any trial conditions shown before confirming payment. A proposed price, design preview, profile badge or marketing description is not itself a completed purchase.

        A recurring subscription may renew on the terms you approve at checkout. Manage or cancel renewal through the provider that billed you, including Apple subscription controls where relevant, or contact support for help identifying the correct provider. Cancellation generally concerns future renewals; any remaining access and refund eligibility depend on the purchase terms and applicable law.

        Deleting an account or uninstalling Yupzap does not automatically cancel a provider-managed subscription. Keep the receipt or transaction identifier for billing queries, without sending card credentials. Mandatory refund, cancellation and consumer-protection rights take priority over a provider or service policy.

        Paying does not prove identity, business ownership, expertise, notability or endorsement. Verification claims require their own evidence and review. A change to price or renewal terms must follow applicable notice and consent requirements.

          Content decisions and account restrictions

          We may remove or limit content, restrict features, suspend an account or terminate access for a policy violation, a valid legal requirement or a necessary response to serious safety or security risk. The response should take account of severity, context, recurrence and the risk involved. Urgent protective action may be needed before a full review.

          A report alone is not proof of a violation. Where lawful and appropriate, affected users should receive an explanation and a way to challenge a decision. Use Account status where available or contact support with the content or account identifier, the decision and why you believe it was mistaken. Do not evade a restriction while an appeal is reviewed.

          Appeals do not guarantee restoration and cannot override a binding legal restriction. Contacting support does not waive access to an applicable statutory grievance or appeal process, consumer remedy or court.

            Availability, external services and responsibility

            We work to provide the service, but interruptions, software errors and changes can occur. Keep copies of important original files. Yupzap is not an emergency-response service; contact the appropriate emergency service if someone is in immediate danger.

            Other users control their own statements and independent actions. A link or third-party integration is not a promise that material is accurate, licensed for your intended use or safe in every context. Review separate provider terms when using an external service.

            You are responsible for your own unlawful conduct and material you submit to the extent the law provides. Yupzap remains responsible for its own obligations. These terms do not impose blanket liability on users for every third-party claim, exclude responsibility for fraud or wilful misconduct, or limit statutory consumer and privacy rights.

              Lawful requests and preservation

              We may need to restrict access, preserve relevant records or disclose information in response to valid legal process or mandatory reporting duties. Requests must identify the requesting authority, lawful basis, scope and information sought. We may seek clarification or object to an invalid or overbroad request where permitted.

              Notice to an affected person may be limited by law or an immediate safety risk. A privacy or deletion request does not require destruction of records subject to a valid preservation obligation. Such retention is limited to its lawful purpose.

                Leaving Yupzap and changes to these terms

                You may stop using the service and request deletion through the account-deletion process. Follow separate subscription cancellation instructions if you have a recurring purchase. Content licences and record retention after deletion are limited as explained above and in the Privacy policy.

                We may update these terms to reflect service or legal changes. Material changes should be communicated appropriately before they take effect where required. Changes do not retrospectively remove accrued rights or required consent. If you disagree, you can stop using the service and request deletion; applicable refund or other statutory rights remain available.

                  Questions, grievances and applicable rights

                  Contact support with a clear description of an account, service or billing concern. For copyright, use [email protected]. Include relevant identifiers and your requested outcome, not passwords or sign-in codes.

                  Indian law applies to these terms to the extent permitted by applicable conflict-of-law rules. Mandatory protections in your place of residence and the jurisdiction of competent courts or statutory bodies are preserved. These terms do not require you to waive a consumer forum, statutory appeal, regulator complaint or other remedy that cannot lawfully be excluded.

                  If a provision cannot be enforced, the remaining provisions apply only so far as lawful and consistent with the agreement. A delay in enforcing a right is not a permanent waiver of it.

                    No music or media from Yupzap

                    Yupzap does not provide, host a library of or license any music, sounds or other third-party media. There is no music picker or sound library in the app, and nothing on Yupzap gives you permission to use someone else's work.

                    Everything you post must be yours, or used with the permission of the rights holder or under a legal exception that applies to you. This includes any music, song, voice, sound effect, clip or footage inside your videos and photos. Music usually has separate rights in the song itself and in each recording of it. Buying a track, having a streaming subscription, giving credit or using only a short clip does not by itself give you the right to post it.

                    Yupzap is an intermediary under section 79 of the Information Technology Act, 2000. Users choose what they post and who sees it. We host and deliver that content and act on valid notices as set out in our Copyright policy.

                      Reporting and takedown

                      Anyone can report copyright infringement from the 3-dot menu on any post, video or Moment. Choose Copyright infringement, give the owner's name and a link to or description of the original work, and confirm that you are the owner or authorised to act for the owner. We acknowledge a notice within 24 hours and act on valid notices within 36 hours, or sooner where the law requires. Repeat infringement is handled under the strike policy in our Copyright policy.

                        Grievance Officer

                        Under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer is Mr. Amit Sharma. Email [email protected]. Yupzap is operated by Merdot Private Limited.

                          How your content is stored and deleted

                          The Privacy policy explains where your content is kept, how long it stays on our servers and what happens when you delete a post or your account. Deleting content removes it from view on Yupzap. It does not recall copies that other people saved, downloaded or shared outside Yupzap.

                            App, website and brand permissions

                            Subject to these terms, you may use the app and website for their intended functions. Yupzap software, interface designs, logos and other materials remain owned by their respective rights holders. No sale or transfer of those rights is implied. Third-party and open-source components remain subject to their applicable licences.

                            Do not sell access to Yupzap, misrepresent an affiliation, redistribute proprietary components or bypass technical restrictions. This does not limit lawful interoperability, accessibility work, security research or other rights that cannot be restricted by contract. Linking to a public page does not grant permission to use the Yupzap brand as an endorsement.

                              Business accounts, promotions and advertising

                              If you act for an organisation, you must have authority to do so. Identify the actual business behind an offer and provide accurate contact, price, delivery, cancellation and refund information. Obtain the permissions needed to contact people and process their information; a public profile or group membership is not blanket marketing consent.

                              Clearly disclose paid partnerships, gifts, affiliate relationships and other material commercial connections where required. Do not use fabricated testimonials, hidden recurring charges, deceptive urgency or unsupported health or financial claims. You are responsible for the legality and fulfilment of your own offer. Yupzap is not a party to a transaction between users unless an express purchase agreement says otherwise.

                              A competition or giveaway must state its organiser, eligibility, dates, selection process, prize and material conditions. Do not imply that Yupzap sponsors or guarantees it without written authorisation. These terms do not authorise regulated gambling, unlawful lotteries or any restricted sale.

                                Editing tools and generated content

                                A filter, template, cutout, remix or generation tool does not establish ownership or permission to use a person’s image, voice, work or brand. Obtain the necessary rights before submitting source material and before distributing the result. Check results for inaccuracies, harmful representations and third-party rights.

                                An AI-generated result may be similar to another result and may not qualify for exclusive rights under every law. No promise of originality, factual accuracy or non-infringement arises merely because a tool produced it. This does not exclude mandatory service obligations or remedies.

                                Where a feature asks for a declaration about realistic synthetic media, answer accurately and preserve required labels. Do not create deceptive impersonations, forged evidence or non-consensual intimate material. A label does not make otherwise unlawful content permissible.

                                  Losses, claims and limits of responsibility

                                  To the extent permitted by applicable law, we do not guarantee uninterrupted access, a particular audience size, commercial income or the accuracy of another user’s statements. We do not accept liability for speculative business opportunities or losses that are not legally attributable to a breach by us. A court or competent forum determines the effect of these provisions under the governing law.

                                  Nothing excludes or limits liability where doing so is unlawful, including applicable consumer remedies and responsibility for fraud, wilful misconduct or other non-excludable conduct. There is no blanket waiver of privacy rights, remedies for a deficient paid service or rights to report an incident.

                                  A claim arising from your unlawful conduct or infringement must be assessed on its facts, causation and applicable law. You are not required by these terms to indemnify Yupzap for its own wrongdoing or to pay an unproven demand. Parties should take reasonable steps to avoid preventable loss and preserve relevant evidence lawfully.

                                    Notices, changes and interpretation

                                    Feature-specific terms shown before you use a feature may supplement these terms. For a conflict, the specific terms govern only that feature to the extent lawful; mandatory rights take priority. A marketing statement cannot cancel a binding purchase commitment or statutory remedy.

                                    Material contractual changes require appropriate notice and any consent required by law. Continued use is not a substitute for consent where explicit consent is necessary. We do not use a later revision to retrospectively remove an accrued claim.

                                    If a provision is unenforceable, the remainder applies only to the extent it can lawfully operate. A delay in enforcement is not necessarily a waiver. Neither a change in corporate ownership nor a transfer of contractual rights removes accrued user rights or applicable data-protection duties. Contact support for a copy of the policy applicable to a particular date.

                                      Groups, administrators and shared access

                                      Group administrators may use the membership and moderation controls actually available to them. Being an administrator does not confer ownership of another member’s content, authority to disclose private information, or permission to represent Yupzap.

                                      Explain any additional group rules clearly and apply them lawfully. Platform rules still apply. Do not add people to abusive or deceptive groups, sell access using misleading claims or use membership lists for unsolicited marketing. A member can report a concern even if an administrator approves the conduct.

                                      For organisational accounts, keep access limited to authorised people and remove access when their role ends using supported controls. Do not share personal sign-in secrets as a substitute for an approved access mechanism.

                                        Mistaken charges and purchase disputes

                                        If a charge appears unauthorised, duplicated or inconsistent with the agreed price, contact the billing provider and support with the transaction reference, date and amount. Do not send full card numbers or authentication codes. Prompt reporting helps investigation but does not shorten a statutory claim period.

                                        Refund decisions must account for the actual purchase terms, delivery of the paid service, the billing provider’s process and mandatory law. These terms impose no blanket no-refund rule or automatic punishment for a good-faith payment dispute. Knowingly false claims and fraudulent payment activity may be investigated.

                                        A paid service that is withdrawn or materially changed must be handled in accordance with applicable contractual and consumer obligations. Support should explain the available remedy rather than treat a general service-availability disclaimer as a substitute for it.
